DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS
This Declaration made on the date hereinafter set forth by 370 BRONSON ROAD, LLC, a Connecticut LLC authorized to do business in the Commonwealth of Massachusetts, with a post office address at Post Office Box 2465, Black Rock Turnpike, Fairfield, CT 06825, hereinafter referred to as (Declarant).
WHEREAS, Declarant is the owner of certain property (hereinafter referred to as the [ Property]) in Becket, Berkshire County, Massachusetts, which is shown on two plans as follows:
Plan 1, entitled [Plan of Land in Becket, Massachusetts, Being a Subdivision of Land Shown on Land Court Plan 3793C and 3794B, Prepared For PRPSA VENTURES, LLC, Leonhardt Road and Tyne Road, Becket, MA, Prepared by Foresight Land Services, Dated March 2, 2005,] Sheet 3 (Land Court Survey Plan 3793I) showing Lot 21, and Sheet 5 (Land Court Survey Plan 3794D) showing Lots 2, 3, 4 and 5, and Parcel 6 and
Plan 2, entitled [Plan of Land in Becket, Massachusetts, being a Subdivision of Land shown on Land Court Plans 3793C, Prepared for PRPSA VENTURES, LLC, Leonhardt Road, Becket, MA, Prepared by Foresight Land Services, Dated March 2, 2005], Sheet 1 (Land Court Survey Plan 3793J), showing Lots 23 and 24.
Plan 1 and Plan 2 are hereinafter collectively referred to as [Plans].
WHEREAS, it is the purpose of these Covenants, Conditions and Restrictions to provide conditions for the development of the Property owned by Declarant for single family residential use with the intention to preserve and protect the natural beauty and wooded character of the property for the benefit of its Owners.
WHEREAS, the Declarant intends hereby to establish a set of covenants, conditions and restrictions which shall affect Lots numbered 2, 3, 4, 5, 21, 23 and 24 as shown on said Plans. Said Lots on said Plans are hereafter referred to individually as [Lot] or collectively as [Lots]. The Declarant hereby reserves the right to add nine (9) additional Lots, all of which are proximate to Yokum Pond, ( [Nine Additional Lots] ) in one (1) additional phase or a total of sixteen (16) Lots to be governed by this Declaration of Covenants, Conditions and Restrictions, by the recording of an Amendment in the Berkshire Middle District Registry of Deeds signed by the Declarant, along with a Land Court Plan identifying the Lots to be added.
WHEREAS, the Declarant intends to hereby establish an Architectural Review Committee (ARC) to administer and control building on the Lots and administer [no cut zones] that are shown on the individual plans for each Lot, in each case in a manner that will achieve the visual separation of homes to the extent feasible, one from another by means
